Terms & Conditions
Last updated: October 3, 2026
These Terms & Conditions ("Terms") describe how Growth Helm AI ("Growth Helm," "we," "us," or "our") provides managed business systems, CRM, automation, website, communication, reporting, and advisory services to small businesses. They are written in plain language so they are easy to understand. We want you to know what to expect and what we ask of you in return.
1. Acceptance of Terms
2. Description of Services
Growth Helm provides managed CRM, lead-management, workflow, communication, website, automation, reporting, integration, AI-assisted, and business-support services. We configure, build, and manage business technology on behalf of our clients rather than simply handing over software.
Services may include CRM setup and management; lead capture; contact management; opportunity and sales pipeline management; forms and surveys; appointment scheduling; email, SMS, and phone communication; workflow automation; missed-call follow-up; review and reputation tools; website design and redesign; website hosting and maintenance through third-party platforms; landing pages and funnels; business email setup; domain and DNS configuration assistance; online listings; reporting and dashboards; AI-assisted tools; integrations; client onboarding; business process consulting; ongoing account support; system optimization; and additional related business technology services added in the future.
Growth Helm may use third-party technology platforms to provide these services. The specific services provided to each client vary and are defined by that client's accepted subscription, estimate, invoice, proposal, statement of work, or other written agreement. Not every feature or service is included in every subscription or project.
3. Service Plans and Scope
Services may be provided through one-time projects, setup fees, recurring subscriptions, usage-based services, add-ons, or custom work. The applicable scope, pricing, included services, and payment terms are defined in the client's accepted proposal, estimate, invoice, subscription, or written agreement.
Work outside the agreed scope may require additional charges and client approval before it begins. We will not knowingly start billable work beyond the agreed scope without discussing it with you first.
4. Fees and Billing
Clients are responsible for the charges agreed to for Growth Helm services according to their accepted proposal, estimate, invoice, subscription, or written agreement.
Some services may create additional third-party or usage-based charges, including SMS and MMS usage; phone numbers and phone calls; email sending; AI usage; domains; Google Workspace; online listings; payment processing; advertising spend; integrations; software subscriptions; registration fees; and other third-party platform charges. Third-party pricing is controlled by the third-party provider and may change independently of Growth Helm.
Growth Helm will not knowingly add a material recurring paid service without client approval unless it is already included in an accepted agreement or plan. You are responsible for any third-party charges you authorize or that arise from services included in your agreement.
5. Client Responsibilities
To help us deliver the Services effectively, you agree to:
- • Provide accurate business information and keep it current.
- • Provide necessary access to systems, accounts, and content where needed.
- • Maintain legal authority over the data and information you provide to us.
- • Review and approve important business content before it is published or sent.
- • Maintain lawful communications practices for your business.
- • Obtain any required consent from your own customers, contacts, and recipients.
- • Comply with applicable laws and industry regulations.
- • Review business-critical information for accuracy before relying on it.
- • Maintain appropriate account security for your own systems.
6. SMS and Messaging
Opt-in consent: By providing your mobile number through a form, checkbox, keyword, or other opt-in method, you expressly consent to receive recurring automated and non-automated SMS text messages from Growth Helm AI (or from a system we configure for your business) related to your inquiry, appointment reminders, follow-up, and similar communications. Message frequency varies. Standard message and data rates from your carrier may apply.
Opt-out: You may cancel the SMS messaging program at any time by replying STOP to any message. You may receive one final confirmation message confirming your opt-out. To rejoin, reply START or opt in again through the appropriate form.
Help: For support, reply HELP or contact us at robert.bower@growthhelmai.com. Carriers are not liable for delayed or undelivered messages.
Your responsibilities: If you use a Growth Helm-configured messaging system to reach your own customers, you are responsible for obtaining and documenting appropriate consent from your contacts, honoring opt-out requests, and complying with applicable messaging and telecommunications regulations. Growth Helm AI is not liable for misrepresentations, non-compliant messaging practices, or carrier decisions regarding your campaign registration.
7. Websites, Domains, and Client Assets
You retain ownership of your own domain names, logos, trademarks, business content, photographs you own or provide, client-supplied documents, client-owned data, and other client-owned intellectual property.
Websites may operate on third-party platforms and may require an active subscription to that platform to function. We do not promise that a website can always be exported as portable source code.
If you terminate Growth Helm services, we may reasonably assist with transferring eligible accounts, data, domains, or assets where the underlying platform technically supports transfer. Some third-party integrations may need to be reconnected after a transfer, and you may need your own subscription with the underlying platform to keep the site or system running.
8. Cancellation and Account Access
When a recurring Growth Helm subscription ends, your access to Growth Helm-managed services may end, including CRM access, workflows, automation, forms, calendars, reporting, communication tools, AI features, ongoing support, and websites hosted within subscription-dependent platforms.
You retain ownership of your domain, branding, client-provided content, and client-owned data. Where technically supported, Growth Helm may assist with transferring your eligible sub-account or system to another provider or to an account you control. Any transfer may require you to obtain your own subscription with the underlying platform.
9. Data and System Access
To provide the agreed Services, Growth Helm may receive authorized access to your systems such as CRM, websites, domains, analytics, calendars, forms, communications, business profiles, and connected integrations. We use delegated or approved access methods where practical.
You should not provide sensitive credentials unnecessarily. Where a platform supports delegated or user-level access, please use that instead of sharing primary account passwords. Your use of the Services is also governed by our Privacy Notice.
10. Artificial Intelligence
Growth Helm may use AI-assisted tools for tasks such as content drafting, website editing, workflow assistance, data summaries, survey summaries, customer communications, business analysis, reporting, and administrative assistance. AI is one of several tools we use to make the system more effective; it is not the entire service.
AI output may contain errors, and important information may require human review. AI-generated output is not legal, financial, tax, medical, or other regulated professional advice. We do not represent that AI outputs are always accurate.
11. No Guaranteed Results
Growth Helm does not guarantee leads, revenue, sales, conversion rates, search rankings, website traffic, customer reviews, advertising performance, messaging delivery, profitability, cost savings, or business growth.
We provide systems, tools, configuration, automation, reporting, and guidance. Business results depend on many factors outside Growth Helm's control, including market conditions, your industry, your offerings, your responsiveness, and the actions of third parties.
12. Third-Party Services
Growth Helm may rely on third-party providers for services such as CRM, hosting, communications, email, phone, AI, analytics, payment processing, domains, advertising, online listings, and integrations.
We do not control third-party pricing, outages, suspensions, policy changes, carrier filtering, algorithm changes, or service availability. Third-party terms and policies apply to your use of those services.
13. Intellectual Property
Client-owned materials remain the client's property. Growth Helm retains ownership of its reusable templates, internal processes, methodologies, documentation, reusable workflows, internal tools, branding, and pre-existing intellectual property.
Client-specific paid deliverables may be used by the client according to the applicable agreement. Growth Helm may reuse general knowledge, non-client-specific templates, processes, and methods that do not disclose confidential client information.
14. Confidentiality
Growth Helm will use reasonable care with confidential client information and will not intentionally disclose it except where needed to provide the Services, use authorized service providers bound by appropriate confidentiality obligations, or comply with applicable law.
15. Service Availability
No technology service can be guaranteed to operate continuously. Third-party maintenance, outages, integrations, internet issues, email providers, carriers, AI systems, or platform changes may affect service availability. We will work to restore access and communicate with you when material disruptions occur.
16. Limitation of Liability
To the maximum extent permitted by law, Growth Helm AI and its operators shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits or revenue, arising from your use of the Site or Services, including any SMS messaging program, website, automation, or third-party integration. Our total liability for any claim is limited to the amount you have paid us for the Services in the preceding twelve (12) months, subject to applicable law.
17. Termination and Suspension
Either party may terminate services according to the applicable subscription, agreement, estimate, or invoice terms. Outstanding balances remain due. Third-party charges already incurred remain the client's responsibility where applicable.
Growth Helm may suspend or terminate services for nonpayment, unlawful use, security concerns, abuse, or serious violations of these Terms, and will provide notice where reasonably possible.
18. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Central Texas.
19. Changes to Terms
Growth Helm may update these Terms as our services, technology, applicable laws, and business operations change. Material changes will be reflected by updating the revision date at the top of this page. Continued use of the Site or Services after changes constitutes acceptance of the updated Terms.
